They only call them shysters in the US.    Up in Canada we are respectable barristers and solicitors!   

Do you have to wear the wig as well?    Are they split in Canada like they are in England?  One goes to court and the other doesn't?

No, we no longer have a divided bar in Canada - not for a long time.  Even England has fused their bar so Rumpole could theoretically draft mortgages and a solicitor could theoretically appear in court.  I don't know how much of that actually goes on.

The wigs (peruques, for those who need crossword clues) were also dropped long ago, although we do still wear lawyers robes (drawn from English practice) when appearing in the higher courts.

In practice lawyers here often polarize into either barrister or solicitor, simply because trying to keep a practice going that needs you in the office all day is hard to do if you are out on trial for a week or more.

Might be a stupid ? but if someone stored a tune wheather it be a stock or wester's or GMPP tune in the tune repository could one DL that tune as long as they had HP tuners software onto there vehicle as long as it was the correct yr and tune for there application?
Is that even legal if you stored a tune that was a custom tune or GMPP tune for others to use even if there's no profit involved?
Lets say a person stored a custom tune on the website for a specific yr of vehicle lets say it said custom tune for stock 2008 GXP.  Could anyone that has HP tuners software just copy the tune onto there vehicle if they had a stock 2008 GXP?

Sure you can, that's the idea behind the tune repository. You open up your tune and compare it to the downloaded tune and copy any differences between them to your own tune, unless its the gmpp tune then you need to do full write to the ecm.
As for the legality for sharing the gmpp tune is anyone's guess, normally i would say no its not legal to do that, but has gm ever sued anyone for selling/sharing gmpp tunes? I doubt it, so people will continue to do it. But i think werks is trying to shield themselves by giving away their modded gmpp tune for free if you order the whole $575 package rather than selling it for profit, maybe they know something we don't.

I wonder how guys like Westers feel about selling one tune and then the dozens of others who might have become customers just download it for free from the guy they sold it to because he put it in some 'repository'?

Having read thru this thread a few times, it seems as if the answers are all in copyright law.  I don't know a damn thing about Copyright law, but that would seem like a great place to start.  It also seems like someone who does know the laws has already answered most of the questions here.  Anybody feel like going back to school for 6 years, passing the Bar and becoming KP's designated "legal counsel"?  Yeah, I didn't think so....

EDIT: after a few hours of reading (yes, really) I have found this short summary to most adequately describe what is allowable in the US for computer programs when it comes to making a copy ie: HPTuners:

Section 117 is a limitation on the rights granted to holders of copyright on computer programs. The limitation allows the owner of a particular copy of a copyrighted computer program to make copies or adaptations of the program for any of a number of reasons:

Utilization of the program. The user is allowed to install the software to his hard disk and run the software in memory.
Making backup and archival copies. The user is allowed to make copies of the software to protect himself from loss in the event of the original distribution media being damaged.
Making copies of software in order to repair or maintain machines, provided that the copies used in repairing the machine is destroyed after the repair or maintenance is complete.


As said before, the First Sale Doctrine allows the program to be resold by the end user, but does not allow copies to be made and sold OR for a copy to be made and kept when the original is sold.  Any copies made leagally under the above rules must acompany the original when sold or be destroyed.  Really, it seems to be common sense.  If it were your program, you don't care if someone uses it and when they no longer need it, they sell it to someone else, but you wouldn't want copies of your stuff being made all over the place.

NOTE: as said before, I am not a lawyer not proficient in the art of law.  These are just my findings after some research. 

Also, in respect to the originator of this piece of thread, I do not belive you were looking to make profit, it seems to me you were asking if it was even possible?  I don't know.  I don't have HP Tuners (yet) so I can not speak from experience there.

When you know that anyone can use hptuners to read your tune, copy it and give it to someone else you should in a way expect that people will share it. I thought westers stopped giving out his tunes and expected everyone to send in the ecm so he can lock it somehow to protect his tune.
Look what Vince at Trifecta did, made his own operating system in the ecm so only his software can read it, hptuners doesn't recognize it so no one can copy it.

I hate to say this But once enough People get all this tuning "Down Pat" Who's going to Buy it if theres no protection of whats yours . I think it starting to get  a Little Out of hand. Soon the Tuning Companies will Start charging High Prices.
