What would you guys do?
« on: March 11, 2010, 09:01:01 PM »
Ok a few weeks ago I purchased a Kappashere clear bra for the hood and for the bumper off Ebay for $200.
The seller had sold his GXP and said he never opened the tube and was selling the bra new but AS IS.
When I got the item one of the pieces that goes to the passenger side fender by the headlight was messed up wrinkled with cradboard debris on the adhesive side.  Emailed the guy several times and he basically said he didnt open it but he sold it as is.
Called Kappashere and they pulled his order from three years ago and said he actually ordered 3 kits at the same time which was the hood, bumper and headlight/foglight kits. Kappashere  also stated they should have come all in ONE tube so the tube had to be opened so that would mean the seller lied that he had not opened the tube.  In addition they no longer use the same vendor as they used 3 yrs ago and now the hood piece is all one piece and not 3 pieces for the hood, main hood piece and one for each side fender by the headlight.  They said I could purchase a new hood bra for $200 or just cut off the messed up part of that side fender piece.
My ? is since I did get a good deal do I just suck it up and install all the bra except the messed up piece or do I just file a claim with Paypal to get a full refund on the purchase since Im covered by Paypal.
Bottom line If I purchase new Id spend more than what I have so far and not get the bumper piece.
What would most of you do?
Thanks

The kit cost over $400 just for the Hood and Bumper kit so $200 is really a good deal for both.
I forgot to mention it also included the covers for the side mirrors.
Really I could go either way but there is one side of me that just wants to get back at the seller for him lying but the other side says if you purchase a new kit you will either need to spend $400 for both or $200 just for the hood or bumper kit if I went with the Kappashere kit.
Anyone out there have another vendors kit that may be better or just as good?

You're screwed. Sold as-is = no warranty = somethings up. (IMHO). You get what you pay for sometimes. File a dispute maybe you'll come out smelling like roses, maybe you won't.

Well not exactly at least that's what Ebay and Paypal has stated.
Since he sold the item as NEW the seller is bound by that statement and really cannot say AS IS.
If he would have been selling it as used or just would have sold it as is then that would have been a different story but he put New.
Both Ebay and Paypal said that the fact he omitted information about the rest of the kit has really no bearing on there judgement.  The fact that the item was being sold new makes all the difference and I would more than likely be intitiled to a full refund by Paypal as long as I follow there instructions on sending the item back to the seller even if seller refuses to take the item back.  Pretty much Paypal said that seller as well as I are bound by whatever decesion Paypal makes in a filed claim no matter how each of us feels about the matter.  If one of us doesn't agree with the decesion the seller doesn't have to accept Paypal and I dont have to pay through Paypal from then on anymore.
So we'll see how this plays out.
Thanks guys

To be honest, I would not even try to install it.  If it has been sitting for 3 years, the effectiveness of the adhesive side has probably been compromised.  I would file a claim with eBay or PayPal and try to get your money back...plus, the guy lied to you.  That's what I would do.  Tony from ASAP has a quality clear bra kit and it is affordable.

Honestly I would file a claim thru PayPal. It may take a while to get the issue resolves though. The seller intentionally LIED, reason enuff for him to have to return $$$$$$$.You have to pay to mail it back to him though.

I learned a very valuable lesson about Ebay/ PayPay a few years ago.I hope the seller doesn't live in Argentina! A resolution thru PayPal may take a while. I wish ya lots of luck!
